What a referral agent can and cannot do

This is the part people get wrong, so here it is plainly.

You can

  • Keep your California license active and in good standing
  • Refer buyers and sellers to any licensed agent, in any state
  • Earn a referral fee, commonly 20 to 35 percent of the receiving agent's commission
  • Refer yourself when you are buying or selling your own property
  • Be listed as an affiliated agent of the brokerage
  • Keep the tax treatment that comes with holding an active license

You cannot

  • List property or take listings
  • Represent a buyer or a seller in a transaction
  • Show property, write offers, or negotiate for a client
  • Access the MLS
  • Advertise yourself as available to list or sell

How the money actually works

A friend mentions they are selling. You introduce them to one of our active agents, or to any agent you trust anywhere in the country. We paper the referral before the deal closes. When it closes, escrow pays the brokerage and the brokerage pays you.
